What are California work time laws?

California labor laws are designed to protect workers’ rights and ensure fair compensation. Non-exempt employees aged 18+ are legally allowed to work six consecutive days in a week with a daily limit of 8 hours and a weekly maximum of 40 hours. Minor employees (aged 16 to 17) follow the same rules, provided their job is not illegal and they are not required to attend school by law.

If an employee works beyond these standards, they are entitled to overtime pay at 1.5 times their regular hourly wage, with double-time pay for over 12 hours in a day or 8 hours on the 7th consecutive workday.

 

What are California break laws?

  • Rest Breaks in California:
    • Non-exempt employees in California are allowed to take a paid rest break lasting for ten minutes after every four hours of work.
    • Rest break laws can be adjusted to accommodate different occupations including limited break periods for 24-hour residential care facility workers, interim breaks for athletes, and staggered breaks for on-site construction workers.
  • Meal Breaks in California:
    • Employees are entitled to a 30-minute unpaid meal break after five hours of consecutive work. For shifts over 10 hours, a second meal break is required.
    • Motion picture employees are entitled to receive a meal break lasting 30 minutes to an hour for every 6 hours of consecutive work.
    • Note that meal breaks are only unpaid if the employee is relieved of all job duties. If the employee is not relieved of their duty or is required to remain on-site, the meal break is compensable.
